You understand that Hero911 Network, LLC (“the Owner”) has established a voluntary Hero911 Network exclusive to federal, state and local law enforcement officers, active or retired, off or on duty. These officers have volunteered to be the recipients of alerts immediately informing them of an armed intrusion or active shooter emergency at a nearby school or other institution or gathering place. A Licensor with whom the Owner is affiliated (“the Licensor”) has designed a mobile application for the Hero911 Network that would permit its volunteer members to receive the alerts. The Licensor has contracted with schools and other institutional customers who wish to have the ability, using the Licensor’s proprietary mobile device applications, to alert the nearby members of the Hero911 Network in the event of an armed intrusion or active shooter emergency.

By loading this application on your cell phone or other mobile device, you, the User, hereby certify that you have read, understand, and agree to the following conditions of use:

You certify that you are an active law enforcement officer in good standing of a federal, state or local law enforcement agency, or a retired officer in good standing, as defined in accordance with 18 USC § 926C, a “qualified retired law enforcement officer.”

You agree to adhere to your law enforcement agency’s procedures and guidelines for responding on or off duty to an emergency where you received a Hero911 Network alert.

You agree that if you choose to respond to a Hero911 Network alert while off-duty and/or in plain clothes, you will carry police identification that readily identifies yourself as a law enforcement officer and you will make every effort to notify the agency of jurisdiction of your response, including your physical and clothing description, agency of employment, and response location, when at all possible and prior to responding. You agree to notify same immediately afterwards, once the situation allows.

You understand that retired officers certified to carry a concealed weapon through legislation have no authority as a police officer. They remain private citizens without law enforcement authority and are bound to legal standards of a citizen with regard to use of force.

You promise to safeguard your Hero911 Network alert application, and not to permit unauthorized users to access it, at any time, for any reason.

You understand that neither the Owner nor the Licensor make any warranties or promises about the accuracy of any alert signal, and are not responsible for the outcome of any armed intrusion or active shooter incident.

You understand that the Owner and the Licensor are not your insurers. You certify that you are fully responsible for any and all loss, damage and or injury, including death, that may be caused by you in the course of responding to an alert, and you will hold the Owner and the Licensor harmless from any claim or suit arising out of your response to such an alert, whether or not the Owner and/or the Licensor are partially or wholly at fault.

You certify that you are aware of the risks and hazards, including the risk of serious physical injury or death, inherent in responding to an alert. You certify that, being fully aware of such risks, you elect to participate as an enrolled volunteer in the Hero911 Network. In so doing, you assume the risk of all loss, damage and or injury, including death, that may be sustained by you in the course of responding to an alert, and you will hold the Owner and the Licensor harmless from any claim or suit arising out of your response to such an alert, whether or not the Owner and/or the Licensor are partially or wholly at fault.

You agree that the Owner’s and the Licensor’s entire joint liability for all damage and or loss of property, lives or limbs caused by their failure of any duty or obligation shall be limited to a single recovery for a total amount not to exceed $2,500.00, and the recovery of that single amount constitutes your sole and exclusive remedy against the Owner and/or the Licensor, their agents, assigns or employees, for the occurrence or occurrences sued upon, whether or not the Owner and/or the Licensor are partially or wholly at fault.

You agree to receive email, text and push communications from the Owner regarding information relevant to this application. The Owner agrees to not share your personal information with outside parties.

You agree to immediately uninstall the Hero911 Network application on your mobile device upon your separation or withdrawal from the voluntary Hero911 Network.

You also agree to immediately uninstall the Hero911 Network application on your mobile device if you become an inactive law enforcement officer, or a retired officer not in good standing, as defined in accordance with 18 USC § 926C, a “qualified retired law enforcement officer.”
